URBEE - Terms of Use

Welcome to URBEE, the freelancing home services platform that connects Users with trusted Service Providers for a variety of home services. By accessing or using the URBEE mobile application ("App") or website ("Site"), you agree to comply with and be bound by these Terms of Use ("Terms"). These Terms govern your access to and use of the URBEE platform, and form a legally binding agreement between you and URBEE.

Please read these Terms carefully. If you do not agree to these Terms, you may not access or use the App or Site.

1. Definitions

  • "URBEE,"      "we," "us," or "our" refers to URBEE, the provider of the platform.
  • "User" refers to any individual or entity using the      URBEE platform to request home services.
  • "Service      Provider" refers to any      individual or entity offering home services through the URBEE platform.
  • "Platform" refers to the URBEE mobile application and      website collectively.
  • "Services" refers to the home services offered by Service      Providers and requested by Users through the URBEE platform.
  • "Account" refers to the user profile created by both Users      and Service Providers to access the URBEE platform.

2. Eligibility

2.1 For Users:

  • You      must be at least 18 years old and have the legal capacity to enter into a      binding contract to use the URBEE platform.
  • By      registering as a User, you represent and warrant that the information you      provide during the registration process is accurate, current, and      complete.

2.2 For Service Providers:

  • Service      Providers must be legally authorized to provide the services they offer      through the URBEE platform.
  • Service      Providers must comply with all applicable laws, regulations, and industry      standards governing their services.
  • By      registering as a Service Provider, you represent and warrant that you      possess the necessary licenses, qualifications, and certifications to      provide the services you offer.

3. Account Registration

3.1 Creating an Account:

  • Both      Users and Service Providers must create an account to access the URBEE platform.      The registration process requires providing certain personal and/or      business information.
  • You      agree to provide true, accurate, current, and complete information during      registration and to maintain and promptly update this information to      ensure it remains accurate and complete.

3.2 Account Responsibilities:

  • You      are responsible for maintaining the confidentiality of your account      credentials, including your username and password, and for all activities      that occur under your account.
  • You      agree to notify URBEE immediately of any unauthorized use of your account      or any other breach of security.
  • URBEE      is not liable for any loss or damage resulting from your failure to      safeguard your account information.

3.3 Multiple Accounts:

  • You      may not create multiple accounts for fraudulent or deceptive purposes.      Each individual or entity is limited to one account as a User and/or one      account as a Service Provider unless expressly authorized by URBEE.

4. Use of the Platform

4.1 For Users:

  • Users      may use the URBEE platform to browse, request, and schedule home services      provided by Service Providers.
  • Users      agree to provide accurate and complete information about the services      requested, including any specific requirements or preferences.
  • Users      are responsible for ensuring that the service location is accessible,      safe, and suitable for the Service Provider to perform the requested      services.
  • Users      agree to pay for all services requested through the URBEE platform,      including any applicable fees and taxes.

4.2 For Service Providers:

  • Service      Providers may use the URBEE platform to create a profile, list their      services, and accept service requests from Users.
  • Service      Providers agree to provide services in a professional, competent, and      timely manner, in accordance with industry standards and any specific      agreements made with the User.
  • Service      Providers must accurately describe the services they offer, including      pricing, availability, and any relevant qualifications or certifications.
  • Service      Providers are responsible for their own tools, equipment, and supplies      needed to perform the services.

4.3 Prohibited Activities:

  • You      may not use the URBEE platform for any illegal, unauthorized, or improper      purpose. Prohibited activities include, but are not limited to:
    • Engaging       in fraudulent, deceptive, or dishonest activities.
    • Harassing,       threatening, or abusing other users of the platform.
    • Uploading       or sharing content that is defamatory, obscene, or violates the rights of       others.
    • Interfering       with the operation of the platform, including hacking, malware, or any       other malicious activities.
    • Attempting       to gain unauthorized access to other accounts, systems, or networks       associated with the URBEE platform.

5. Service Requests, Payments, and Cancellations

5.1 Service Requests:

  • Users      may submit service requests through the URBEE platform by selecting a      Service Provider based on their profile, ratings, reviews, and      availability.
  • Service      Providers have the discretion to accept or decline service requests based      on their availability, expertise, and other factors.
  • Once      a service request is accepted, a binding agreement is formed between the      User and the Service Provider, subject to the terms and conditions of this      agreement.

5.2 Payments:

  • All      payments for services must be made through the URBEE platform using the      payment methods provided. Payments are processed by third-party payment      processors.
  • Users      agree to pay the total amount due for the services requested, including      any applicable fees and taxes, as specified at the time of booking.
  • Service      Providers agree to receive payments through the URBEE platform, and      authorize URBEE to deduct any applicable service fees before remitting      payment to the Service Provider.
  • Payments      to Service Providers are typically processed within [Insert Payment      Processing Time], subject to any delays or holds imposed by the payment      processor or URBEE for security reasons.

5.3 Cancellations and Refunds:

  • Users      may cancel service requests in accordance with URBEE’s cancellation      policy. The cancellation policy, including any applicable fees, will be      displayed at the time of booking.
  • Service      Providers may also cancel accepted service requests, but frequent      cancellations may result in penalties or suspension of the Service      Provider’s account.
  • Refunds      for canceled services will be processed in accordance with URBEE’s refund      policy. Refunds may be issued to the original payment method, or as      credits to the User’s account, at URBEE’s discretion.

6. Ratings, Reviews, and Feedback

6.1 User Ratings and Reviews:

  • After      completing a service, Users have the opportunity to rate and review the      Service Provider. Ratings and reviews are intended to provide valuable      feedback to the URBEE community and to help maintain high standards of      service quality.
  • Ratings      and reviews must be honest, fair, and based on the User’s actual      experience with the Service Provider. URBEE does not tolerate fake,      misleading, or malicious reviews.
  • Users      acknowledge that their ratings and reviews may be publicly visible on the      URBEE platform, and that URBEE may use, reproduce, and distribute such      content for promotional or other purposes.

6.2 Service Provider Feedback:

  • Service      Providers may also provide feedback on Users after completing a service.      Feedback should be constructive, professional, and based on the actual      service interaction.
  • URBEE      may use this feedback to assess User behavior, address complaints, and      improve the overall platform experience.

6.3 Review Moderation:

  • URBEE      reserves the right to remove or modify ratings, reviews, or feedback that      violate these Terms, contain inappropriate content, or are deemed      irrelevant or unhelpful.
  • URBEE      may also take action against Users or Service Providers who repeatedly      receive negative feedback, including suspension or termination of their      accounts.

7. Verification and Background Checks

7.1 Aadhar Verification and KYC for Service Providers:

  • URBEE      requires Service Providers to complete Aadhar verification and Know Your      Customer (KYC) procedures to ensure their identity, qualifications, and      trustworthiness.
  • By      providing your Aadhar information, you authorize URBEE to verify your      identity, conduct background checks, and share your verified status with      Users.
  • Service      Providers who fail to complete verification or who provide false or      misleading information may have their accounts suspended or terminated.

7.2 Optional Verification for Users:

  • URBEE      may offer optional Aadhar verification for Users to enhance trust and      security within the platform. Users who choose to verify their identity      may have a verified badge displayed on their profile.

7.3 Confidentiality and Privacy:

  • URBEE      is committed to protecting the privacy and confidentiality of your      personal information during the verification process. All information      provided for verification purposes will be handled in accordance with our      Privacy Policy.

8. Intellectual Property Rights

8.1 URBEE’s Intellectual Property:

  • All      content, trademarks, logos, and other intellectual property on the URBEE      platform are owned by URBEE or licensed to us. This includes, but is not      limited to, text, graphics, logos, icons, images, audio clips, video      clips, software, and code.
  • You      may not use, reproduce, distribute, or create derivative works from any      content on the platform without our prior written consent.

8.2 User and Service Provider Content:

  • By      submitting content (including text, images, videos, and reviews) to the      URBEE platform, you grant URBEE a non-exclusive, worldwide, royalty-free,      and perpetual license to use, reproduce, modify, adapt, publish,      translate, create derivative works from, distribute, and display such      content in any media.
  • You      represent and warrant that you own or have the necessary rights and      permissions to grant this license to URBEE.

8.3 Infringement Claims:

  • If      you believe that your intellectual property rights have been violated on      the URBEE platform, please notify us immediately at [Insert Contact      Information] with a detailed description of the alleged infringement.      URBEE will investigate the claim and take appropriate action, which may      include removing the infringing content or disabling the infringing      account.

9. Dispute Resolution

9.1 Governing Law:

  • These      Terms are governed by and construed in accordance with the laws of [Insert      Jurisdiction], without regard to its conflict of law principles.

9.2 Informal Resolution:

  • In      the event of a dispute between a User and a Service Provider, or between      either party and URBEE, the parties agree to first attempt to resolve the      dispute informally by contacting URBEE’s customer support team at [Insert      Contact Information].
  • URBEE      will make reasonable efforts to address and resolve the dispute in a fair      and timely manner.

9.3 Mediation and Arbitration:

  • If      the dispute cannot be resolved informally, the parties agree to submit the      dispute to mediation or binding arbitration in [Insert Jurisdiction], in      accordance with the rules of [Insert Arbitration Organization].
  • The      parties agree to share the costs of mediation or arbitration equally,      unless otherwise determined by the mediator or arbitrator.

9.4 Class Action Waiver:

10. Limitation of Liability

10.1 No Warranty:

  • URBEE      provides the platform on an "as is" and "as available"      basis, without warranties of any kind, either express or implied,      including but not limited to warranties of merchantability, fitness for a      particular purpose, and non-infringement.
  • URBEE      does not warrant that the platform will be error-free, uninterrupted,      secure, or free from viruses or other harmful components.

10.2 Limitation of Damages:

  • In      no event shall URBEE be liable for any indirect, incidental, special,      consequential, or punitive damages, including but not limited to lost      profits, loss of data, or loss of goodwill, arising out of or in      connection with your use of the platform, even if URBEE has been advised      of the possibility of such damages.
  • URBEE’s      total liability to you for any claims arising out of or related to these      Terms or your use of the platform shall not exceed the amount you paid to      URBEE in the twelve (12) months preceding the claim.

10.3 Service Provider Liability:

  • Service      Providers are solely responsible for the services they provide to Users      through the URBEE platform. URBEE is not liable for any damages, injuries,      or losses resulting from the services provided by Service Providers.

11. Termination

11.1 Termination by URBEE:

  • URBEE      may suspend or terminate your account, access to the platform, or these      Terms at any time, with or without notice, for any reason, including but      not limited to your violation of these Terms or any applicable laws.
  • Upon      termination, you must immediately cease all use of the platform, and URBEE      may delete your account and any associated content or information.

11.2 Termination by User or Service Provider:

  • You      may terminate your account at any time by following the account      termination instructions provided on the platform or by contacting URBEE      customer support at [Insert Contact Information].
  • Termination      of your account does not relieve you of any obligations or liabilities      incurred prior to termination.

11.3 Survival of Provisions:

  • The      provisions of these Terms that by their nature should survive termination      shall survive termination, including but not limited to provisions      regarding intellectual property, dispute resolution, limitation of      liability, and indemnification.

12. Amendments to Terms

12.1 Right to Amend:

  • URBEE      reserves the right to amend or modify these Terms at any time, in its sole      discretion. Any changes to these Terms will be effective immediately upon      posting on the URBEE platform or notifying you via email or other means.
  • Your      continued use of the platform after the effective date of any changes      constitutes your acceptance of the revised Terms.

12.2 Material Changes:

  • If      URBEE makes material changes to these Terms, we will provide notice to      Users and Service Providers by posting a prominent notice on the platform      or by sending an email to the email address associated with your account.

13. Miscellaneous

13.1 Entire Agreement:

  • These      Terms, along with the Privacy Policy and any other agreements or policies      referenced herein, constitute the entire agreement between you and URBEE      regarding your use of the platform, and supersede any prior or      contemporaneous agreements, communications, or understandings, whether      written or oral.

13.2 Severability:

  • If      any provision of these Terms is found to be invalid or unenforceable by a      court of competent jurisdiction, the remaining provisions of these Terms      shall remain in full force and effect.

13.3 Waiver:

  • The      failure of URBEE to enforce any right or provision of these Terms shall      not constitute a waiver of such right or provision.

13.4 Assignment:

  • You      may not assign or transfer these Terms, or any rights or obligations      hereunder, without the prior written consent of URBEE. URBEE may assign or      transfer these Terms, or any rights or obligations hereunder, in its sole      discretion.
